Aximus Labs provides AI phone answering and ordering for restaurants. Our AI answers calls on a restaurant's behalf, answers questions, takes orders and reservations, sends orders to the restaurant's POS, and, with the caller's consent, Aximus Labs may text the caller a confirmation.

Program: Aximus Labs Order Texts, operated by Aximus Labs LLC.

Messages we send:

• Caller confirmations: order and reservation confirmations that Aximus Labs sends to people who call a restaurant using our service and agree, during the call, to receive a text.
• Restaurant alerts: new-order and booking alerts, plus service notifications, that Aximus Labs sends to restaurant owners and staff who opt in on our sign-up form.

We do not send marketing or promotional text messages.

How you opt in:

• During a call: our automated AI phone assistant asks, "Can Aximus Labs text a confirmation of this order to the number you're calling from? Message and data rates may apply. Message frequency varies. Reply STOP to opt out or HELP for help. Our terms and privacy policy are at aximuslabs.com. Do I have your permission to send you these texts? Please say yes or no." We send a text only if you say yes.
• On our website: by checking the optional, unchecked SMS consent box on our sign-up form at https://aximuslabs.com.

Consent to receive text messages is not a condition of any purchase.

Frequency and cost: Message frequency varies. Message and data rates may apply.

Opt out and help: Reply STOP to any message to opt out. You will receive one confirmation message and no further messages unless you opt in again. Reply HELP for help, or email hello@aximuslabs.com.

Carriers are not liable for delayed or undelivered messages. Delivery depends on your wireless carrier and is not guaranteed.

Privacy: Your information is handled as described in our Privacy Policy at https://aximuslabs.com/privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging opt-in data and consent will not be shared with any third parties.

Orders and reservations placed through Aximus Labs are made with the restaurant, not with us. The restaurant is responsible for its menu, prices, food preparation, fulfillment, refunds and any allergy or dietary information. Payments for orders are processed by third-party payment processors.

• Our AI reads orders back before sending them, but it can make mistakes. Please review your confirmation and contact the restaurant about any errors.
• Allergy and food safety questions are passed to restaurant staff. Do not rely on the AI for allergy or medical information.
• The service is not for emergencies. If you have an emergency, call 911.

Calls handled by our AI may be recorded and transcribed so restaurants can review orders, and so we can improve accuracy and quality. By continuing a call, you consent to recording and transcription.

If you use the service as a restaurant, you agree to:

• Provide accurate menu, pricing, hours and contact information and keep it up to date.
• Comply with laws that apply to your business, including laws on call recording notices, text messaging consent and consumer protection.
• Pay the fees for your plan as shown on our website or in your order form. Monthly plans can be cancelled at any time; yearly plans are paid up front.
• Keep your dashboard login secure and tell us promptly about any unauthorized use.

You agree not to misuse the website or service, including by placing fraudulent orders, attempting to interfere with or reverse engineer the service, sending unlawful or harassing content, or using the service to send messages to people who have not consented.

The website, service, software and branding are owned by Aximus Labs LLC or its licensors. Restaurants keep ownership of their menus, logos and business content and give us permission to use them to provide the service.

The service works with third-party products such as POS systems, telephone carriers and payment processors. We are not responsible for third-party services, and your use of them is subject to their own terms.

The website and service are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted or error free.

To the fullest extent permitted by law, Aximus Labs LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim, or $100 if you have not paid us anything.

Restaurants agree to indemnify and hold Aximus Labs LLC harmless from claims arising from their menu content, food, fulfillment, or violation of these Terms or applicable law.

We may suspend or end access to the service if you violate these Terms or use the service in a way that could cause harm. Restaurants may cancel as described in their plan. Sections that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Mecklenburg County, North Carolina.

We may update these Terms from time to time. We will post the updated version on this page and change the date at the top. Continuing to use the service after changes take effect means you accept the updated Terms.
